Supreme court allows AAP’s mayoral candidate to withdraw plea as election notified

Supreme court allows AAP’s mayoral candidate to withdraw plea as election notified

The Supreme Court on Friday allowed Aam Aadmi Party (AAP) mayoral candidate Shelly Oberoi to withdraw her plea saying that the Delhi MCD mayoral elections are scheduled to be held on February 6.

Chief Justice DY Chandrachud and Justice PS Narasimha told senior advocate Abhishek Manu Singh that the main complaint of the petitioner was that the mayoral election was not held but now the election has been announced.
Singhvi said that though the mayoral election prayer has become futile after the announcement of the February 6 poll, other issues such as MLA polling remain.

The court said that if this is the case, it will have to stop the proceedings, which the petitioner does not want. "We will allow you to withdraw it on the basis that elections are being held, but we will give you freedom to come back in case of any grievances," the bench said, allowing the application to be withdrawn.

On January 27, the apex court agreed to list Oberoi's plea for hearing on February 3, which sought directions on how to conduct the mayoral election in Delhi in a time-bound manner. The mayoral election in the national capital was put on hold for the second time last month as the Municipal Corporation of Delhi (MCD) house was adjourned indefinitely by the chairman appointed by the lieutenant governor following an uproar created by some councillors.

The first meeting of the newly elected MCD House was also adjourned on January 6 amid uproar from AAP and BJP members. AAP won 134 out of 250 wards in the MCD polls held in December. BJP managed to win 104 wards.
